Official Rules

RAFFLE

Voices for Children of Okeechobee and the Treasure Coast, Inc., 7548 S. US Highway 1, Suite 172, Port St Lucie, FL 34952, is conducting a raffle pursuant to Florida Statutes section 849.0935 to raise funds to support the Guardian ad Litem program in the 19th Judicial Circuit (Indian River, Martin, Okeechobee and St. Lucie counties).

These rules govern the raffle, including eligibility and participation, selection and qualification of the winner and delivery of the prize. These rules bind every person, no matter whether read or not, who acquires or holds a raffle ticket as well as any person who requests a raffle ticket.

PRIZE

The holder of the winning raffle ticket drawn will be able to choose to receive either a New 2017 Ford Focus, supplied by Sunrise Ford Company, 5435 US-1, Fort Pierce, FL 34982 or $5,000 cash (Winner’s option).
The car model, color and options included will be determined solely by Sunrise Ford. The winner who selects to receive the automobile will be responsible to pay Sunrise Ford for any additional dealer installed options that the winner wants. Voices for Children of Okeechobee and the Treasure Coast, Inc will not, in any way, be responsible for these costs.
The holder of the winning raffle ticket drawn who chooses to receive the automobile must pay to Sunrise Ford all fees for registration, tag, title transfer and Florida sales tax before receiving the automobile. In addition, all required Federal withholding tax must be paid to Voices for Children of Okeechobee and the Treasure Coast, Inc. before receiving the automobile.
At the time of the drawing, the first ticket chosen will be declared the winner, while an additional three tickets will also be chosen. If the winner of the raffle declines to accept either the car or the $5,000 cash option, he or she will forfeit their claim to either prize. Then the holder of the second ticket chosen will be given the option to select either the car or the cash prize option, and subsequently then the third and finally the owner of the fourth ticket chosen.

The raffle winner must meet all requirements stated in these rules to receive and take delivery of the Ford Focus automobile, including

  • (i) being at least 18 years of age,
  • (ii) having a valid driver’s license and appropriate insurance and
  • (iii) satisfying all other tax and legal requirements on and as of the date of delivery of the automobile, as determined by Voices for Children of Okeechobee and the Treasure Coast, Inc. in its sole and absolute discretion.

If the winning raffle ticket holder does not meet the above requirements, the only prize option available is the $5,000 cash.
The New 2017 Ford Focus has been provided to Voices for Children of Okeechobee and the Treasure Coast, Inc. by Sunrise Ford. The additional funds needed to cover the balance of the acquisition cost of the Ford Focus automobile will be provided by raffle ticket proceeds, Ultimate Tailgate Party (“Event “) ticket sales and other individual sponsors of the Event.

ELIGIBILITY

To be eligible to obtain a raffle ticket and participate in the raffle, and if applicable choose a prize, a Ticket Holder must

  • (i) be a U.S. resident legally residing in the United States (and, in the case of entries by mail, be a Florida resident legally residing in the State of Florida ) and
  • (ii) not be precluded by these rules or any Applicable Law from acquiring or holding a raffle ticket, participating in the raffle or if applicable choosing a raffle prize.

A person cannot be a Ticket Holder if such person is

  • (i) one with whom U.S. persons or entities are restricted from doing business under regulations of the Office of Foreign Asset Control (OFAC) of the U.S. Department of the Treasury (including those names on OFAC’s Specially Designated and Blocked Persons List) or any statute or executive order or
  • (ii) who is acting, directly or indirectly, for or on behalf of any such person. Individual sponsors of the Ultimate Tailgate Party will receive raffle tickets, depending on their level of sponsorship, as part of their sponsorship benefit package and may transfer those raffle tickets to other eligible individuals, as they desire.

In addition, members of the Board of Directors of Voices for Children of Okeechobee and the Treasure Coast, Inc, employees and Volunteers of the Guardian ad Litem program and their families can enter the raffle and win the option to receive either the car or the cash prize.

ENTRIES

Raffle tickets are available for a suggested minimum donation of $25 per ticket or $100 for five (5) raffle tickets. Pursuant to Florida law, no purchase or other consideration is necessary.
Raffle tickets donations may be made with cash, check or credit card. If the raffle ticket donation is made on the Voices website, voicesforchildrenotc.org, the donor may be required to enter on the site the raffle ticket numbers that have been paid for, as well as, the credit card information.
Only one person’s name may appear on the raffle ticket stub which will be entered into the drawing for the raffle prize. If by mistake or otherwise more than one name is entered on the raffle ticket stub, Voices for Children of Okeechobee and the Treasure Coast, Inc, in its sole and absolute discretion, may deem the first name on the ticket stub to be the Ticket Holder of record.
Raffle tickets are not assignable or transferable at any time or in any manner, except those included in Ultimate Tailgate Party sponsorship benefit packages. The winner of the raffle drawing that chooses to receive the automobile may not transfer his or her interest in the automobile prior to taking possession of the automobile and paying all required fees and taxes.
The odds of winning the raffle prize will depend on the number of raffle tickets issued. There is no minimum or maximum limit to the total number of raffle tickets to be issued, nor is there a limit to the number of tickets that can be acquired or held by any single eligible Ticket Holder.
Voices for Children of Okeechobee and the Treasure Coast, Inc. is not responsible for printing errors in any raffle-related material or lost, late, misdirected or non-delivered mail, corrupt electronic mail or other electronic or internet messages, service delays or interruptions affecting the U.S. mail, internet service provider or other electronic mail systems.
No refunds or returns will be made. All entries and donations become the property of Voices for Children of Okeechobee and the Treasure Coast, Inc. immediately upon receipt and will not be returned.

DRAWING

The raffle drawing will take place at or about 4:00 P.M. on February 4, 2018 at the Pelican Yacht Club, Fort Pierce, FL. The holder of the winning raffle ticket drawn does not have to be present at the drawing to win the right to receive the automobile or the $5,000 cash (at the Winner’s option).
At the drawing, the winning raffle ticket shall be drawn blindly at random by an independent third party not affiliated with Voices for Children of Okeechobee and the Treasure Coast, Inc from a raffle drum or other container after being thoroughly mixed by such independent third party. An additional three tickets will also be chosen and designated as alternates, in the order drawn.

NOTIFICATION OF WINNER

If not present in person at the drawing, the holder on record of the winning ticket will be notified by telephone and email at the telephone number and email address specified on the winning raffle ticket stub drawn. If no response to such notification by telephone or email is received within 24 hours of such notification, notice will also be sent by certified mail to the address specified on the winning ticket’ s stub. By obtaining a raffle ticket, each ticket holder agrees that any notice given in accordance with the foregoing notice provisions will be sufficient for all purposes of Florida Statute section 849.0935(4)(e). If the holder of the winning raffle ticket does not respond to the above specified notifications and has not within fifteen (15) days after notice has been given as provided in the rules he or she will be deemed to have forfeited their right to choose a prize option and then the next alternate winner drawn pursuant to paragraph 4 under “Prize” above will be notified.

DISCLAIMER; WAIVER; RELEASE; INDEMNIFICATION

Voices for Children of Okeechobee and the Treasure Coast, Inc disclaims and shall have no obligation to any winner to provide or enforce any express or implied warranty for the benefit of a prize winner. No additional warranty will be provided in respect to the automobile other than that supplied by the manufacturer of the 2017 New Ford Focus. No service warranties or extended warranties will be provided by, or paid for, by Voices for Children of Okeechobee and the Treasure Coast and/or Sunshine Ford. The winner of the raffle that selects the automobile prize will have the option of purchasing from Sunshine Ford or another provider extended warranties or service warranties at their option and sole cost.

Each raffle ticket holder by acquiring a raffle ticket

  • (i) represents, warrants, acknowledges and agrees that he or she did not receive any representations, warranty, guarantee, or assurance relative to participating in the raffle or winning any prize and
  • (ii) forever waives, releases and discharges, and agrees to indemnify Voices for Children of Okeechobee and the Treasure Coast, Inc and its board of directors and officers and any third party associated with running the Ultimate Tailgate Party and raffle.

PUBLICITY

The winning raffle ticket holder, by accepting a prize, grants, in perpetuity, to Voices for Children of Okeechobee and the Treasure Coast, and in the case of selection of the New 2017 Ford Focus prize to Sunshine Ford, full permission, except where legally prohibited, to use the winner’s name, address (city and state only), photograph, voice and/or likeness, statements and prize information for advertising, trade and promotional purposes without further compensation.

COMPLIANCE WITH LAWS; TAXES

Each ticket holder’s acquisition of a raffle ticket, participation in the raffle and where applicable receipt and acceptance of a prize shall be done in full compliance with these rules and Applicable Laws. The offer of raffle tickets shall be void where prohibited by Applicable Law.
Voices for Children of Okeechobee and the Treasure Coast, Inc. does not provide any advice, counsel or guidance with respect to compliance with any applicable federal tax laws, rules and regulations, all of which shall be the sole responsibility of the ticket holder. The ticket holder and prize winner is advised to consult his or her own tax advisor with respect to any tax benefits and liabilities that may arise from participating in the raffle.
In respect to the award of the automobile, the raffle prize winner is subject to federal income taxes and state sales tax. In addition, the raffle winner who selects the automobile is subject to federal income tax withholding which must be paid to Voices for Children of Okeechobee and the Treasure Coast prior to receiving delivery of the automobile.

PRIVACY

Ticket holder’s information collected from the raffle ticket will not be sold or otherwise shared with any third-party websites or companies, except as required by Applicable Laws, subpoenas, discovery requests or governmental investigations or inquires.

GOVERNING LAW

The raffle is subject to these rules and Applicable Laws of the State of Florida. If there is a conflict between these rules and any Applicable Law, the Applicable Law shall govern. If there is a dispute of any kind regarding the conduct of this raffle the ticket holder agrees to submit the dispute to binding arbitration.
In no event, will Voices for Children of Okeechobee and the Treasure Coast, Inc, its directors and officers be liable to any party for loss or injury to earnings, profits or goodwill.

MISCELLANEOUS

These rules shall not be changed by any oral statement by any person acting on behalf of Voices for Children of Okeechobee and the Treasure Coast, Inc.
